We have consolidated experience in the management of national and international disputes, thanks to the firm’s network of contacts, both in court and in arbitration in favour of clients, individuals, legal entities, foundations, banks and banking and financial intermediaries.

Contrary to the traditional approach, our litigation, arbitration and ADR department carefully weighs the costs and benefits to the client in identifying defensive strategies, both offensive and defensive, as well as the best procedural solution, proposing the most functional and efficient one for managing the dispute.

Our litigation, arbitration, and ADR department works synergistically with all of the firm’s departments, advising clients at the pre-litigation stage of contractual relations or, more broadly, when a dispute needs to be resolved.

Areas of practice

ADR Alternative dispute resolution

As a result of the most recent legislative innovations and in response to the need to deflate litigation, a number of alternative ways of settling disputes are gaining ground in our legal system.

MEDIATION | Civil and commercial mediation consists of an out-of-court, informal conflict resolution procedure in which a neutral, impartial, independent and competent third party, the mediator, assists the parties by facilitating communication, identifying their interests and helping them reach a mutually satisfactory agreement.

Our Litigation, Arbitration and ADR department is very attentive to the management of this phase, which – in an increasing number of cases – constitutes a condition for the admissibility of a court application and, therefore, a prodromal phase in relation to it. The conclusion of an agreement in mediation that avoids the establishment of a judicial dispute can lead to a considerable advantage for the parties, both for the tax advantages associated with the institution and for the savings in costs and expenses necessary to manage the dispute in court and/or arbitration.

ASSISTED NEGOTIATION | The assisted negotiation procedure was introduced by Legislative Decree no. 132 of 12 September 2014 converted into Law no. 162 of 10 November 2014. It is an agreement by which the parties, assisted by one or more lawyers, agree to cooperate in good faith and with loyalty to resolve a dispute amicably.

The assisted negotiation procedure can be used, as an alternative to ordinary jurisdiction, for any type of dispute as long as it concerns the rights available.

The execution of the assisted negotiation is a condition for the admissibility of the claim for compensation for damage caused by the use of vehicles and boats and for the payment of sums not exceeding Euro 50,000.00 for any reason whatsoever, if it is not one of the cases referred to in Article 5 paragraph 1-bis of Legislative Decree 28/2010, with reference to which the mediation attempt is mandatory.

Judicial Litigation

After unsuccessful attempts at alternative dispute resolution, our litigation, arbitration and ADR department develops the best strategy for the attack or defence in order to help and accompany the client to obtain the appropriate protection of their aggrieved rights before a judge.

Our litigation, arbitration and ADR department specialises in legal assistance before any judicial body, whether of first or second instance, as well as legitimacy before the Supreme Court of Cassation.

Before commencing litigation, our team takes great care to provide the client with the clearest and most detailed information on the costs, risks and possible outcomes of litigation, and to share with the client the key strategic choices, including the procedural tool recommended at each stage.

Precautionary Litigation

In certain cases provided for by law and in the presence of specific prerequisites, our legal system provides for the possibility of “immediate” protection.

These are interlocutory proceedings, i.e., summary proceedings (i.e., proceedings that do not reach the level of depth of the ordinary court of cognisance), the function of which is to “freeze” a disputed legal situation pending a final decision (in proceedings that are already pending or have yet to be instituted) or to grant atypical and immediate protection.

These proceedings are particularly challenging for our lawyers, who have to prepare for the trial or the defence against it within a very tight timeframe, often in order to defend constitutionally guaranteed rights.

Arbitrations

Arbitration is a procedure through which the parties can obtain a resolution to their dispute through the pronouncement of an award (decision) by an arbitrator, a third party, who is identified by agreement between the parties themselves.

If the parties agree beforehand on the recourse to a third-party arbitrator, in the event of a disagreement arising, by means of an arbitration clause, the procedure is faster because the rules to be followed (method of appointing arbitrators, competent seat) will already have been established in advance, etc.)

If it is decided to resort to arbitration after the dispute has already arisen, the parties sign a written agreement called a compromise by which they delegate the decision to a third person, who is extraneous to the facts.

Not all disputes can be subject to an arbitration agreement, but it would be advisable for those involving more than one jurisdiction (international commercial arbitration), i.e., where the commercial parties have different nationalities.

She assists individuals and companies both in the consulting phase and in litigation, out-of-court and in court.

With a solid experience in top Milanese law firms, she combines her skills as a litigator with an academic profile, having obtained a doctorate in Comparative Private Law and worked as a Cultrice della Materia and Research Fellow at the State University of Milan and the University of Milan Bicocca.

Lawyer Marco Ammendola

Marco Ammendola mainly deals with judicial, arbitration and ADR litigation in civil, corporate and commercial matters.
Marco has decades of experience in assisting national and international clients in ordinary cognition, enforcement and precautionary proceedings.
Marco also assisted banks, banking intermediaries and financial intermediaries in litigation concerning alleged violations of the TUB and TUF.
Thanks also to an in-house experience in the European coordination of a major extraordinary transaction, Marco was able to delve into civil, corporate and regulatory issues in the biomedical and life science sector.
